1. Acceptance of these terms

By accessing or using WindTones (the "Service"), you agree to be bound by these Terms of Use. If you do not agree with any part of these terms, you may not use the Service.

These terms constitute the entire agreement between you and WindTones with respect to your use of the platform. They apply to all visitors, registered users, and anyone else who accesses the Service.

2. Description of the service

WindTones is a web-based platform that allows users to browse, play, and upload public-domain musical tunes represented as visual fingering charts for wind instruments. Tunes are stored in ABC notation and rendered in the browser as fingering diagrams and sheet music.

The Service is provided free of charge on a hobbyist basis and without any guarantee of continuous availability or feature completeness. Features may be added, changed, or removed at any time.

3. Accounts

Creating an account allows you to upload tunes, rate versions, and save favorites. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

You agree to provide accurate information when registering and to keep it up to date. You must notify WindTones immediately at alvarezlamasivanroque@gmail.com if you suspect unauthorized use of your account.

Each account is personal and may not be shared, transferred, or sold. WindTones reserves the right to suspend or terminate accounts that violate these terms.

4. Acceptable use

WindTones is dedicated to public-domain music. You may only upload tunes that are unambiguously in the public domain or for which you hold all necessary rights. Uploading content protected by copyright without authorization is strictly prohibited and will result in immediate removal of the content and possible termination of your account.

You agree not to use the Service to distribute spam, engage in abusive behaviour toward other users, attempt to gain unauthorized access to any part of the platform, or interfere with its normal operation. Automated scraping or bulk extraction of content without prior written consent is not permitted.

WindTones reserves the right to determine, at its sole discretion, whether any submitted content or behaviour violates these guidelines.

5. Intellectual property and content licensing

By uploading a tune to WindTones, you represent and warrant that the tune is in the public domain or that you hold all rights necessary to make it available on the platform. You take full responsibility for ensuring that your uploads do not infringe any third-party intellectual property rights.

For any content you upload, you grant WindTones a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display, and distribute that content solely for the purpose of operating and improving the Service. This licence does not affect the public-domain status of the underlying tunes.

The WindTones platform code, design, and brand are the property of WindTones and may not be reproduced or redistributed without express written permission.

6. Content moderation

WindTones administrators review uploaded content and may remove any tune or associated data that appears to infringe copyright, violates these terms, or is otherwise deemed inappropriate for the platform. Removal may occur without prior notice.

7. Account suspension and termination

WindTones may suspend or permanently terminate your account at any time if you breach these terms, engage in fraudulent activity, or pose a risk to other users or the integrity of the platform. Where practical, we will attempt to notify you of the reason.

You may delete your own account at any time. Upon deletion, your personal data will be removed as described in the Privacy Policy. Content you have uploaded may be anonymised or retained in accordance with our content and moderation policies.

8. Disclaimers and limitation of liability

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. WindTones does not guarantee uninterrupted access, error-free operation, or the accuracy and completeness of any content on the platform.

To the fullest extent permitted by applicable law, WindTones shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of or inability to use the Service, including but not limited to loss of data or loss of goodwill.

WindTones does not provide musical education services and takes no responsibility for the accuracy of fingering charts or any musical instruction derived from the platform.

9. Governing law and jurisdiction

These terms are governed by and construed in accordance with Spanish law. Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the competent courts in Spain.

10. Changes to these terms

WindTones reserves the right to update these terms at any time. When material changes are made, registered users will be notified via in-app notice or email. The "Last updated" date at the top of this page will always reflect the most recent revision.

Continued use of the Service after changes take effect constitutes your acceptance of the revised terms.
